1. Introduction

Thank you for visiting akdrones.com. Please read our Terms of Service and this Privacy Policy carefully, as you must agree to both documents to have permission to use our Service. This license is strictly limited to the terms and conditions below, and governed by the Copyright laws of the United States, as specified in Title 17 of the United States Code.

The controller of your personal information is AKdrones LLC doing business as AKdrones (AKdrones), with offices at 1601 W Northern Lights Blvd. Anchorage, AK 99517.

 

2. Definitions

Throughout this document, we may use certain words or phrases; it is essential that you understand their meanings. The following is a non-exhaustive list of definitions of words and phrases found in this document: AKdrones LLC, doing business as AKdrones (“AKdrones”, “our”, “we” or “us”); our Site; our Service; or a combination of all or some of the preceding definitions, depending on the context in which the word is used refers to our company; “Service” refers to the services that we provide through our Site, including our drone services marketplace and our Site itself; “Site” refers to our website, www.akdrones.com; “User” refers to anyone who uses our Service, including general visitors to our Site; “You” refers to you, the person who is entering into this Privacy Policy.

Scope of this Agreement. This Agreement applies to any photograph, graphic, digital asset, or digital image created or taken by AKdrones and delivered to the client for the property in question. This Agreement governs the relationship between the parties, and in no event shall any e-mail communication or other exchange, amend or otherwise modify the terms of this Agreement unless agreed to in writing.

 

3. Rights

All Photos and rights relating to them, including copyright and ownership rights in the media in which the Photos are stored, remain the sole and exclusive property of AKdrones. This license grants the Client the limited right to reproduce, publicly display, and distribute the Photos solely for promotional or advertising purposes directly related to the sale of the Property. Photos used for any purpose not directly related to the sale of the Property must be with the express permission of AKdrones and the payment of additional fees, unless otherwise agreed to in writing.

 

4. Sharing of Your Information

AKdrones does not rent or sell your Personal Information to anyone.

 

5. Uploading to MLS listings

Photos may be uploaded to any MLS listing service solely for the promotion of the Property during the pendency of this Agreement. However, regardless of any terms and conditions of the MLS, at no time does this Agreement provide Client with the right to transfer copyright, or any other exclusive rights as provided by the Copyright Act 17 U.S.C § 106. Photos may contain copyright management information (CMI) at the discretion of AKdrones in the form of either 1) a copyright notice © and/or 2) other copyright and ownership information embedded in the metadata or elsewhere, unless otherwise agreed to by the Parties. Removing and/or altering such information is prohibited and constitutes a violation of the Digital Millennium Copyright Act (DMCA), and Client will be responsible to AKdrones for any penalties and awards available under the statute.

 

6. Data Retention

AKdrones will retain your Personal Information for as long as your account is active or as needed to provide you with services. Any customer data that we have access to shall be retained, stored, and deleted according to our Agreement with our business customer. In some instances, we will delete or anonymize the information you provide to us after it is no longer needed. We also keep information about you and your use of the Service for long as it is necessary for our legitimate business interests, legal reasons (e.g., legal requirements to keep data), and to prevent harm to AKdrones and/or its users, but we shall not keep your Personal Information for more than 7 years after your account becomes inactive.

 

7. No Exclusivity

Relationship of the Parties: The parties agree that AKdrones is an independent contractor, and that neither AKdrones nor AKdrones' employees or contract personnel are, or shall be deemed to be, employees of Client. No agency, partnership, joint venture, or employee-employer relationship is intended or created by this Agreement. Neither party is authorized to act as agent or bind the other party except as expressly stated in this Agreement. AKdrones and the Photos or any other deliverables prepared by AKdrones shall not be deemed a work for hire as defined under Copyright Law. All rights granted to Client are contractual and are expressly defined by this Agreement.

 

8. Transfer and Assignment

The client may not assign or transfer this agreement or any rights granted under it. No amendment or waiver of any terms is binding unless in writing and signed by the parties. However, the invoice may reflect, and the Client is bound by authorizations that could not be confirmed in writing because of insufficient time or other practical considerations.

 

9. General Law/Arbitration

This Agreement sets forth the entire understanding and agreement of the parties and supersedes any and all prior agreements between the parties. This Agreement shall be governed and interpreted, and enforced per the laws of the State of Alaska. Any claim or litigation arising out of this Agreement or its performance may be maintained only in courts physically located in the State of Alaska, and the parties hereby consent to the personal jurisdiction of such courts. In the event of any litigation arising out of or relating to this Agreement, the prevailing party shall be entitled to recover its attorneys’ fees incurred in the litigation. If parties are unable to resolve the dispute by negotiation, either party may start mediation and/or binding arbitration in a forum mutually agreed to by the parties.

 

10. Waiver

No action of either party, other than express written waiver, may be construed to waive any provision of this Agreement, and a single or partial exercise by either party of any such rights or remedies will not preclude further exercise of other rights or remedies.

 

11. Information from Children

We do not knowingly collect personal information from anyone under the age of 21. If you are under 21, please do not register for the Service. If we learn that we have personal information from a child under age 21, we will delete that information. 12. Your Alaska Privacy Rights

Alaska Personal Information Protection Act,

APIPA applies to entities that maintain personal information about Alaska residents in the

course of their business. It requires reasonable security measures to protect personal

information from unauthorized access, use, or disclosure. To make such a request, please

13. LEGAL DISCLAIMER

This Service operates "AS-IS" and "AS-AVAILABLE," without warranties of any other kind.  We are not responsible for events beyond our direct control.  This Privacy Policy is governed by the laws of the State of Alaska, excluding conflicts of law principles. Any legal actions against us arising out of or related to the Service must be commenced in the county of Anchorage in the state of Alaska in the United States of America.

 

14. Changes to this Privacy Policy

We may change this Privacy Policy from time to time. When we change this Privacy Policy, we will update the date at the top of the page.  If we make any material changes to this Privacy Policy, we will post a notice on the website or application notifying users of the changes. In some cases, we may also send messages and notify users of the changes.  You should check this website periodically to see if any recent changes to this Privacy Policy have occurred.
